Whilst this paper was initially part of a larger project tracing the development of Anglo-American thought from the colonial through to the post-colonial era, below it stands alone as reflection on the colonialism of John Stuart Mill read from a post-colonial perspective. It aims to show that Mill's views on colonial rule were largely informed by his principle of liberty which, in turn, was based on his qualitative utilitarianism. The driving force behind his colonialism, as with his work in general, (...) was his unwavering belief in the importance of human progress and development. Mill never believed, as did many of his contemporaries, that the ‘backward’ societies of the colonies were inherently inferior, but rather that they needed paternal intervention from more civilised, progressive societies in order to stimulate growth in that spontaneous human development was not inevitable. When read in this light Mill's views on colonial rule, while culturally bigoted and ethnocentric, appear less contradictory to his liberalism as a whole. (shrink)

For more than four decades the twin goals of nuclear nonproliferation and disarmament have been an almost unchallenged objective of the “international community.” Like drought prevention, or bans on the use of child soldiers, nonproliferation remains a mostly uncontroversial, largely universalistic initiative to which few object. The proponents of nonproliferation are fond of stressing that the Treaty on the Nonproliferation of Nuclear Weapons has more signatories than any other arms control treaty. Following the socialist revolution, a colossal shift in everyday realities began in the 1920s and '30s in the former Russian empire. Faced with the Siberian North, a vast territory considered culturally and technologically backward by the revolutionary government, the Soviets confidently undertook the project of reshaping the ordinary lives of the indigenous peoples in order to fold them into the Soviet state. In Agitating Images, Craig Campbell draws a rich and unsettling cultural portrait of the encounter between indigenous (...) Siberians and Russian communists and reveals how photographs from this period complicate our understanding of this history. Agitating Images provides a glimpse into the first moments of cultural engineering in remote areas of Soviet Siberia. The territories were perceived by outsiders to be on the margins of civilization, replete with shamanic rituals and inhabited by exiles, criminals, and "primitive" indigenous peoples. The Soviets hoped to permanently transform the mythologized landscape by establishing socialist utopian developments designed to incorporate minority cultures into the communist state. This book delves deep into photographic archives from these Soviet programs, but rather than using the photographs to complement an official history, Campbell presents them as anti-illustrations, or intrusions, that confound simple narratives of Soviet bureaucracy and power. Meant to agitate, these images offer critiques that cannot be explained in text alone and, in turn, put into question the nature of photographs as historical artifacts. An innovative approach to challenging historical interpretation, Agitating Images demonstrates how photographs go against accepted premises of Soviet Siberia. All photographs, Campbell argues, communicate in unique ways that present new and even contrary possibilities to the text they illustrate. In the human quest for meaning, work occupies a central position. Most adults spend the majority of their waking hours at work, which often serves as a primary source of purpose, belongingness, and identity. In light of these benefits to employees and their organizations, organizational scholars are increasingly interested in understanding the factors that contribute to meaningful work, such as the design of jobs, interpersonal relationships, and organizational missions and cultures. In a separate line of inquiry, scholars of business ethics (...) have examined meaningful work as a moral issue concerning the management of others and ourselves, exploring whether there are definable characteristics of meaningful work to which we have moral rights, and whether there are moral duties to ourselves and others to fulfill those rights. In this article, we examine contemporary developments in both disciplines about the nature, causes, and consequences of meaningful work; we explore linkages between these disciplines; and we offer conclusions and research opportunities regarding the interface of ethical and organizational perspectives on performing and providing meaningful work. The idea that human beings have a distinct moral worth—a moral significance over and above any moral worth, such as that may be, possessed by other animals—has a long history and has traditionally been taken for granted by philosophers and theologians. However, in a variety of quarters in recent philosophy, this idea has come into disrepute, seeming to indicate a mere prejudice in favour of our own species. For example, Peter Singer has argued that such a position is mere speciesism, (...) a prejudice of a kind with racism and sexism in that it involves making moral distinctions between our own and other species that cannot be morally justified. What on such views is needed to justify any such distinction is a difference in terms of the morally relevant properties possessed by our own species as compared with other species. I will call this view the moral property view. Insofar as other species share with us morally relevant properties, for example the capacity to suffer cognitive ability and so on, it is mere prejudice not to accept moral requirements with respect to them as we do with respect to our own species. While on the surface such a view may seem morally enlightened, it indicates what will seem to many problematic moral judgments with respect to severely disabled human beings. In this paper, I will respond to these concerns by suggesting a different basis for the idea of human moral distinctiveness, one that draws on recent work by Wittgensteinian moral philosophers and which denies what I called above the property view. According to this view, while our shared life with other animals involves the recognition of their moral significance, our shared life with other human beings involves recognising that human beings as human beings have a distinctive moral value. Yet, to many historians of intellectual affairs, the firm establishment of dates and personal relationships is a matter of much importance, and documents such as these, largely devoted as they are to the communication of news about books and writers, the activities of rulers and ambassadors, printers and curious travelers, can be a substantial aid in determining the structure of an historical moment, the succession and interrelationship of events. One is willing to grant that much of what Chapelain wrote to Heinsius is trivial and concerns books and literary news of slight importance, that a delicate irony makes less of some of his comments than they were worth at the time. The Supreme Court has ruled in the case of Y that there is no requirement to seek the approval of the Court of Protection in decisions to withdraw clinically assisted nutrition and hydration from patients in a prolonged disorder of consciousness.1 Mr Y was 52-year-old man who suffered a cardiac arrest after a myocardial infarction as a result of coronary artery disease. It was not possible to resuscitate him for well over 10 min, resulting in severe cerebral hypoxia which caused (...) extensive brain damage. Mr Y’s family and the NHS Trust treating him agreed that Mr Y would not want to be kept alive through the provision of CANH given his poor prognosis. They sought a declaration that it was not mandatory for applications of withdrawal of CANH to come before the court, which was granted by Mrs Justice O’Farrell in the first instance.2 Permission was granted for the appeal to ‘leapfrog’ the Court of Appeal and to proceed to the Supreme Court for consideration. In the interim, Mr Y died after contracting acute respiratory sepsis, but the Supreme Court determined that the appeal should go ahead in light of the general importance of the issues raised. In delivering the opinion of the Supreme Court on 30 July 2018, Lady Justice Black rejected the historical distinction that had been drawn between patients in PDOC and non-PDOC patients, in a way that had justified judicial involvement for patients in PDOC but not for others.3 She was clear that the correct approach to all cases involving CANH was to make a decision based on what was in the best interests of the patient. Pathological archival tissue has been used as a source of research material for many years. The advancement in molecular techniques led to an escalated interest in genetic research on archival tissue. Research on archival tissue has been used without obtaining consents from patients, although the ethical justification for such a practice is unlikely to apply for genetic research that involves whole genome sequencing, for instance. Issues of confidentiality and patients’ autonomy are being raised as institutions consider when approval for this (...) type of research should be granted. In addition, patients’ advocate is mandating some of these changes. In the context of the United Arab Emirates, this paper makes clear the current uncertainties arising from the use of archival tissue in genetic research, as it could be highly invasive of privacy interests and also fails to respect autonomous choice. It further explains what needs to change in order to support such research that is directed at promoting public good, but in a way that is not detrimental to the welfare of patients as research participants. Although theory refers to organizational culture as an important variable in corrupt organizations, only little empirical research has addressed the characteristics of a corrupt organizational culture. Besides some characteristics that go hand in hand with unethical behavior and other features of corrupt organizations, we are still not able to describe a corrupt organizational culture in terms of its underlying assumptions, values, and norms. With a qualitative approach, we studied similarities of organizational culture across different corrupt organizations. In this study, we (...) performed content analysis on interviews of 14 independent experts about their experience with corrupt organizations. With this approach, we gained insights about different corrupt organizations spanning different branches (e.g., government, foreign trade, pharmacy, sports, building industry). We found that corrupt organizations perceive themselves to fight in a war, which leads to their taken-for-granted assumption that “the end justifies the means”. This assumption inspires many values and norms of the organizational culture. An important value in a corrupt organization is “security”, and an important norm is punishment of deviant (i.e., non-corrupt) behavior. Furthermore, managers and employees differ in their perception of organizational culture. While the management endorses values, such as success, results, and performance, and implements these values in their norms of goal setting, employees make use of rationalization strategies and endorse values of security and team spirit. Penal substitution in a theological context is the doctrine that God inflicted upon Christ the suffering which we deserved as the punishment for our sins, as a result of which we no longer deserve punishment. Ever since the time of Faustus Socinus, the doctrine has faced formidable, and some would say insuperable, philosophical challenges. Critics of penal substitution frequently assert that God’s punishing Christ in our place would be an injustice on God’s part. For it is an axiom of retributive (...) justice that it is unjust to punish an innocent person. But Christ was an innocent person. Since God is perfectly just, He cannot therefore have punished Christ. Virtually every premiss in this argument is challengeable. Not all penal substitution theories affirm that Christ was punished for our sins. The argument makes unwarranted assumptions about the ontological foundations of moral duty independent of God’s commands. It presupposes without warrant that God is by nature an unqualified negative retributivist. It overlooks the possibility that the prima facie demands of negative retributive justice might be overridden in Christ’s case by weightier moral considerations. And it takes it for granted that Christ was legally innocent, which is denied by the classic doctrine of imputation. It thus fails to show any injustice in God’s punishing Christ in our place. Moral conclusions cannot validly be inferred from nonmoral premises – this principle, commonly called “Hume’s law,” presents a conundrum. On one hand, it seems obviously true, and its truth is often simply taken for granted. On the other hand, an ingenious argument by A. N. Prior seems to refute it. My aim here is a resolution. I shall argue, first, that Hume’s law is ambiguous, admitting both a strong and a weak interpretation; second, that the strong interpretation is false, as (...) shown by Prior’s argument; and, third, that the weak interpretation is true. Background Several jurisdictions, including Singapore, Australia, New Zealand and most recently Ireland, have a public interest or public good criterion for granting waivers of consent in biomedical research using secondary health data or tissue. However, the concept of the public interest is not well defined in this context, which creates difficulties for institutions, institutional review boards and regulators trying to implement the criterion. Main text This paper clarifies how the public interest criterion can be defensibly deployed. We first explain the (...) ethical basis for requiring waivers to only be granted to studies meeting the public interest criterion, then explore how further criteria may be set to determine the extent to which a given study can legitimately claim to be in the public interest. We propose an approach that does not attempt to measure magnitude of benefit directly, but rather takes into account metrics that are more straightforward to apply. To ensure consistent and justifiable interpretation, research institutions and IRBs should also incorporate procedural features such as transparency and public engagement in determining which studies satisfy the public interest requirement. Conclusion The requirement of public interest for consent waivers in secondary biomedical research should be guided by well-defined criteria for systematic evaluation. Such a criteria and its application need to be periodically subject to intra-committee and intra-institution review, reflection, deliberation and amendment. (shrink)

ABSTRACT Although Kairos in Greek mythology is often depicted as the winged son of Zeus who grants to those who lay hold of his single lock of hair their once-in-a-lifetime opportunity, in traditional African American culture, particularly when it comes to speech, Kairos is essentially family. Given how much African American speakers depend on seizing the moment to invoke spiritual connections, emit laughter, and profess the truth, Kairos, or what we might call CPT (“Colored People’s Time”), can be summoned almost (...) at will. One of the African American discourses this article will use to illustrate this point is Call and Response, a verbal exchange in which speakers and listeners attune to one another and to the timeliness of an event. Martin Luther King Jr.’s “I Have a Dream” speech was such an event, but it wouldn’t have been so were it not for the timely responding of his favorite gospel singer, Mahalia Jackson. (shrink)

Virgil, in his description of the establishment of a new city by Aeneas for those Trojans who wished to remain in Sicily, is thinking of the Roman practice of colonial foundation: ‘Meanwhile Aeneas marked out the city with the plough and allocated the houses ’. We may note the personal role of the founder, the ploughing of the ritual first furrow, the organized grants to the settlers and the equality of treatment implied in the use of lot . Virgil was (...) writing at the end of the first century B.C. at a time of great activity in land distribution, but the Romans had been founding colonies from the mid fourth century. Each colony involved the creation of an urban area and the settlement of people on the surrounding agricultural land, and so perpetuated the city state, which was central to ancient life and culture. Indeed a colony was a smaller image of Rome itself. In the early Republic, colonies, either of Latins or of Roman citizens, were established on the periphery of Roman territory, largely for military and strategic reasons. Between 200 and 173 B.C. more than 40,000 may have received plots of land, amounting to about 1,000 square miles of territory. Later, the motives for colonial foundations became more complex, being closely connected with increasing economic and political problems. There can have been few more important aspects in the development of colonies than the need to find land for discharged troops. These in the main were rank and file soldiers who would expect equal shares in land allocations. (shrink)

Neil Levy mounts two arguments against Robert Kane’s influential libertarian theory. According to the first, because Kanean self-forming actions are undetermined, there can be no contrastive explanation for why agents choose as they do rather than otherwise, in which case how they choose appears to be a matter of luck. According to the second, if one grants Kane the claim that agents are responsible for their undetermined choices in virtue of the fact that they made efforts of will to choose (...) them, the fact that agents engage in dual efforts of will leads to an implausible doubling of the agent’s responsibility. We defend Kane from both objections. We argue against the first by clarifying the nature of contrastive explanation in the context of Kane’s theory and we argue against the second by showing that the kind of doubling of responsibility implied by an agent’s dual efforts of will is, in fact, innocuous. Significant differences in perceptions between teachers in primary and secondary grant-maintained schools are reported and analysed. Parents were more frequently involved in promoting opting-out in primary schools, primary teachers had more favourable attitudes to the grant-maintained school policy and, in primary schools, grant-maintained status delivered improvements in classroom conditions, most notably reduced class size and increased para-professional support in classrooms. The findings are discussed in terms of the management of primary schools, of theorising about reputation management in (...) grant-maintained schools, and of the explicit objectives of the grant-maintained policy. Significant differences in perceptions between teachers in primary and secondary grant-maintained schools are reported and analysed. Parents were more frequently involved in promoting opting-out in primary schools, primary teachers had more favourable attitudes to the grant-maintained school policy and, in primary schools, grant-maintained status delivered improvements in classroom conditions, most notably reduced class size and increased para-professional support in classrooms. The findings are discussed in terms of the management of primary schools, of theorising about reputation management in (...) grant-maintained schools, and of the explicit objectives of the grant-maintained policy. Virgil, in his description of the establishment of a new city by Aeneas for those Trojans who wished to remain in Sicily, is thinking of the Roman practice of colonial foundation: ‘Meanwhile Aeneas marked out the city with the plough and allocated the houses ’. We may note the personal role of the founder, the ploughing of the ritual first furrow, the organized grants to the settlers and the equality of treatment implied in the use of lot. Virgil was writing (...) at the end of the first century B.C. at a time of great activity in land distribution, but the Romans had been founding colonies from the mid fourth century. Each colony involved the creation of an urban area and the settlement of people on the surrounding agricultural land, and so perpetuated the city state, which was central to ancient life and culture. Indeed a colony was a smaller image of Rome itself. In the early Republic, colonies, either of Latins or of Roman citizens, were established on the periphery of Roman territory, largely for military and strategic reasons. Between 200 and 173 B.C. more than 40,000 may have received plots of land, amounting to about 1,000 square miles of territory. Later, the motives for colonial foundations became more complex, being closely connected with increasing economic and political problems. There can have been few more important aspects in the development of colonies than the need to find land for discharged troops. These in the main were rank and file soldiers who would expect equal shares in land allocations. (shrink)

Responding to the Special Issue's call for “new thinking” on gender and governance in developing societies, we introduce our research on the social organization of development knowledge and its ethical implications. Our feminist‐based approach, institutional ethnography, analyses the ruling relations of development and the standpoints represented in knowledge about development and its governance. Our paper offers an alternative to what we see as “the institutional standpoint” prevailing, but taken for granted, in business and society scholarship addressing development. Instead of theorizing (...) development relationships between institutions and their “stakeholders,” we illustrate what can be learned about the social relations of development beginning from the experiences of local subjects. Our analysis of an environmental research and development project in Uzbekistan shows that being missed is knowledge about development subjects that could have revealed what is locally relevant and needed. Instead, we discover gender inequality being constituted, unknowingly, within this project's institutionally generated knowledge and the activities it authorizes. (shrink)

When Congress passed the 19th Amendment in 1919 granting women voting rights, 13 western states had already adopted woman suffrage. Only 2 states outside the West had done so. Using event history analysis, the authors investigate why woman suffrage came early to the western states. Alan Grimes's hypotheses, that native-born, western men were willing to give women the vote to remedy western social problems and to increase the number of women in the region, receive little support in our analysis. Rather, (...) this study finds that woman suffrage came to the West because of the mobilization of the western suffrage movements and because of political and gendered opportunities existing in that region. Debate over the curricula of Black colleges and universities dates back to before the turn of the century and involved such noted Black leaders as Booker T. Washington and W.E.B. DuBois. The 1890 Land-Grant Colleges eventually established in 17 southern and border states were created to provide institutions for the teaching of the agricultural and mechanical arts to African-Americans. However, due to their being chronically underfunded and understaffed during the early decades of their existence, they focused mainly on teacher (...) training and to a large extent became state normal schools or teacher colleges for Blacks. I argue that the improvements in public education of southern Blacks at the primary and secondary levels during the 1920s and 1930s induced many graduates of the 1890 institutions to become teachers. At the same time the growing numbers and higher quality of these individuals lead to an increase in the returns to time spent in school and induced increasing numbers of Black parents to send their children to school. During the 1930s expenditures per pupil in Black public schools increased, as did the real wages of Black teachers, while average classroom size fell. At the same time both literacy and school attendance of southern Blacks rose. In no small part these changes were due to 1890 colleges and their students. (shrink)

The Republic of Ireland has some of the most restrictive abortion legislation in the world which grants to the ‘unborn’ an equal right to life to that of the pregnant woman. This article outlines recent developments in the public discourse on abortion in Ireland and explains the particular cultural and religious context that informs the ethical case for access to abortion services. Our perspective rests on respect for two very familiar moral principles – autonomy and justice – which are at (...) the centre of social and democratic societies around the world. This article explains the context for the deployment of these concepts in order to support the claim that the current legislation and its operationalisation in clinical practice poses serious risks to the health, lives and well-being of pregnant women, tramples on their autonomy rights and requires of them a self-sacrifice that is unreasonable and unjust.
